Terms of Service
SubletSync is a marketplace platform. We connect people — we are not a landlord, tenant, property manager, or party to any sublease agreement. Read this carefully before using the platform.
1. What SubletSync Is (and Is Not)
SubletSync, Inc. ("SubletSync," "we," "us") operates an online marketplace that allows users to list, discover, and inquire about sublease opportunities. SubletSync is a technology platform only.
SubletSync is not:
- A party to any sublease agreement between users
- A real estate broker, agent, or property manager
- A guarantor of any listing's accuracy, availability, or legality
- Responsible for any transaction, dispute, or outcome between users
All sublease agreements are solely between the lister and the sublessee. SubletSync has no obligation to mediate, arbitrate, or resolve disputes between users.
2. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts to use SubletSync. By creating an account, you confirm you meet these requirements. If you are using SubletSync on behalf of a company or organization, you represent that you have authority to bind that entity.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at hello@subletsync.com if you suspect unauthorized access.
We reserve the right to suspend or terminate accounts that violate these Terms, post fraudulent listings, harass other users, or engage in any activity we deem harmful to the platform or its users.
4. Listings — Lister Responsibilities
By posting a listing on SubletSync, you represent and warrant that:
- You have the legal right to sublease the property (check your lease agreement and local laws)
- All information in your listing is accurate, complete, and not misleading
- Your listing does not violate any applicable law, regulation, or third-party right
- You will honor the terms of any agreement you enter into with a sublessee
- Photos and descriptions are of the actual property being listed
SubletSync does not verify listing accuracy. We are not responsible for discrepancies between listings and actual properties.
5. Listings — Sublessee Responsibilities
Before entering any sublease agreement, you are solely responsible for:
- Verifying the property exists and matches the listing
- Confirming the lister has the right to sublease
- Reviewing and understanding the sublease agreement
- Ensuring the sublease complies with local laws and the primary lease
- Conducting any due diligence you deem necessary
6. Prohibited Conduct
You may not use SubletSync to:
- Post false, fraudulent, or misleading listings
- Scam, deceive, or defraud other users
- Harass, threaten, or discriminate against other users
- Violate the Fair Housing Act or any applicable anti-discrimination law
- Collect payments outside of SubletSync's escrow system (once available)
- Scrape, copy, or redistribute content from SubletSync without permission
- Use automated bots or scripts to access the platform
- Attempt to bypass security features or gain unauthorized access
7. Payments and Escrow
When escrow is enabled, payments are processed and held by Stripe, Inc. SubletSync charges a platform fee (currently 5% of the transaction) for facilitating escrow transactions. SubletSync is not responsible for Stripe's actions, errors, or service interruptions. Stripe's terms of service apply to all payment processing.
SubletSync does not hold, store, or have access to your payment card information. All payment data is handled by Stripe in accordance with PCI-DSS standards.
8. Fees
Posting a listing is free. SubletSync may charge fees for featured listings, premium memberships, and escrow transactions. All fees are disclosed before you are charged. Fees are non-refundable unless otherwise stated.
9. Disclaimer of Warranties
SubletSync is provided "as is" and "as available" without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the platform will be uninterrupted, error-free, or free of viruses. We do not warrant the accuracy of any listing, user profile, or verification badge displayed on the platform.
10. Limitation of Liability
To the maximum extent permitted by law, SubletSync and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or property — arising out of or in connection with your use of the platform, even if advised of the possibility of such damages.
In no event shall SubletSync's total liability to you exceed the greater of (a) the fees you paid to SubletSync in the 12 months preceding the claim, or (b) $100.
11. Indemnification
You agree to indemnify, defend, and hold harmless SubletSync and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the platform, your listings, your violation of these Terms, or your violation of any third-party rights.
12. Intellectual Property
SubletSync and its logos, design, and content are owned by SubletSync and protected by applicable intellectual property laws. You may not use SubletSync's branding without written permission.
By posting content (listings, photos, descriptions) on SubletSync, you grant SubletSync a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute that content for the purpose of operating the platform.
13. Privacy
Your use of SubletSync is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
14. Modifications
We may update these Terms at any time. We will notify you of material changes by email or by displaying a notice on the platform. Continued use of SubletSync after changes constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Travis County, Texas.
